Bankruptcy Law Practice

The
Bankruptcy Process

completion of your case.
Filing the bankruptcy petition
"automatically stays" or stops most collection actions against
your property. An automatic stay is a court order that prohibits
creditors from taking any further collection action against you
without first obtaining the permission of the bankruptcy court.
Therefore, filing of the bankruptcy petition on your behalf by
Jason Karavias, Esq. will immediately:
- stop creditors from contacting or calling
you demanding payment or harassing you in any manner;
- stop wage garnishments, such as having
money deducted from your paycheck to pay your creditors;
- prevent creditors from initiating or
continuing any lawsuits for nonpayment against you; and
- prohibit creditors who previously obtained
judgments against you from removing any money from your bank
accounts.
You will attend a meeting
with the case trustee. Jason Karavias,

- attend the required
meeting with the case trustee with you and be by your side to
assist you with legal advice while the trustee questions you
regarding your financial affairs and property;
- provide the case trustee
and United States trustee with the documentation they require in
order to conduct the meeting; and
- through his professional
preparation of the bankruptcy petition and presence and
representation at the meeting, significantly increase the
likelihood that the trustee will be satisfied that your case is
being handled properly.
Communication with the court, trustees,
and your creditors will need to be maintained throughout the
period your case is pending. Jason Karavias, Esq. will advise you
of all communications and correspondences received from the court,
the case trustee, the United States trustee, and each of your
creditors, to keep you fully informed of the status and
developments in your case until its conclusion. Often requests
are made which require timely and dated responses to avoid
detriment to your case, so knowing that your lawyer is constantly
overseeing and managing your case will be comforting.
The Discharge is a permanent court
order prohibiting your creditors from taking any form of
collection action against you in the future on your discharged
debts, including legal action and communications with you, such as
telephone calls and letters. The discharge has the effect of
extinguishing your personal liability on discharged debts.
