How Does Chapter 7 Bankruptcy Work?

Chapter 7 bankruptcy will effectively eliminate most forms of unsecured debt, including:

  • Credit card debt
  • Medical bills
  • Loans and lines of credit

The process typically takes about three months. After that time, your unsecured debt will be completely erased, and you can begin rebuilding your credit.

Determining Chapter 7 Eligibility

The first step is to determine if you are eligible to file for Chapter 7. The best way to find out if you will be approved for Chapter 7 is to speak with a knowledgeable lawyer. Drawing on more than 10 years of experience in bankruptcy law, I will carefully assess your situation by reviewing various documents such as tax returns, pay stubs, copies of bills and other important information. After reviewing these items, I will make a recommendation.

Filing the Chapter 7 Bankruptcy Petition

If I believe you are a good candidate for Chapter 7 bankruptcy and that this is the best option for you, we can move forward, and I will file all of the appropriate documents for you in a timely manner. Once the Chapter 7 bankruptcy petition is filed, an automatic stay goes into effect that stops all collections activities and harassment from creditors.

The Chapter 7 Court Proceeding

You will meet with a trustee who will oversee your Chapter 7 bankruptcy proceedings in court. I will prepare all necessary documents, prepare you for any questions you may be asked and personally accompany you to the court proceeding and represent you at this meeting. Upon approval of your petition, you will receive a discharge order that will permanently prevent creditors from trying to collect from you.
